ENVIRONMENTAL AND SOCIAL COMMITMENT PLAN

  1. The Arab Republic of Egypt (hereinafter the Borrower) through the Egyptian National Railway under the Ministry of Transport shall implement the Railway Improvement and Safety in project (hereinafter the Project). The International Bank for Reconstruction and Development (hereinafter the Bank) has agreed to provide financing for the Project.
  2. The Borrower shall implement material measures and actions so that the Project is implemented in accordance with the Environmental and Social Standards (ESSs) under the World Bank’s Environmental and Social Framework (ESF). To this end, this Environmental and Social Commitment Plan (ESCP) sets out a summary of the material measures and actions to be carried out or caused to be carried out by the Borrower, including the timeframes of the actions and measures, institutional, staffing, training, monitoring and reporting arrangements, grievance management and the environmental and social assessments and instruments to be prepared or updated, disclosed, consulted, adopted and implemented under the ESCP and the ESSs, all in a manner acceptable to the Bank
  3. Implementation of the material measures and actions set out in this ESCP shall be monitored and reported to the Bank by the Borrower through the Egyptian National Railway/Ministry of Transport as required by the ESCP and the provision of the Loan agreement. The Bank will monitor and assess progress and completion of the material measures and actions throughout implementation of the Project.
  4. As agreed by the Bank and the Borrower through the Egyptian National Railway/Ministry of Transport, this ESCP may be revised from time to time during Project implementation, to reflect adaptive management of Project changes and unforeseen circumstances or in response to assessment of Project performance conducted under the ESCP itself. In such circumstances, he Borrower through the Egyptian National Railway/Ministry of Transport will agree to the changes with the Bank and will update the ESCP to reflect such changes. Agreement on changes to the ESCP shall be documented through an exchange of letters signed by the Bank and the Borrower through the Egyptian National Railway/Ministry of Transport, the Borrower through the Egyptian National Railway/Ministry of Transport shall disclose the updated ESCP promptly. Depending on the project, the ESCP may also specify the funding necessary for completion of a measure or action.
  5.  Where Project changes, unforeseen circumstances, or Project performance result in changes to the risks and impacts during Project implementation, the Borrower shall provide additional funds, if needed, to implement actions and measures to address such risks and impacts, which may include environmental, social, health, and safety impacts.

 

MATERIAL MEASURES AND ACTIONS

REGULAR REPORTING: Prepare and submit to the Bank regular monitoring reports regarding the implementation of the material measures and actions to mitigate potential environmental and social risks and impacts. The monitoring reports should include the environmental, social, health and safety (ESHS) performance of the Project, the implementation of the ESCP, the status of preparation and implementation of E&S documents required under the ESCP, stakeholder engagement activities, and functioning of the grievance mechanism(s). The content of the monitoring report will be further specified in the Project Operations Manual. 

Starting from the Effective Date, quarterly progress reports throughout Project implementation

B

INCIDENTS AND ACCIDENTS:  

The Borrower through the (PMU) shall promptly provide notification to the Bank of any incident or accident related to the Project which has, or is likely to have, a significant adverse effect on the environment, the affected communities, the public or workers, including social and economic aspects, as well as indirect environmental and social aspects, in addition to associated occupational health and safety incidents and accidents.

The Borrower, through the PIU shall provide sufficient details regarding the incident or accident, indicating immediate measures taken to address the issue. It will include information provided by any contractor and supervising entity, as appropriate. As per the Bank request, prepare a detailed incident/ accident report and propose any measures to prevent its recurrence.

Notify the Bank within 24- 48 hours after learning about the occurrence of the incident or accident.

C

CONTRACTORS MONTHLY REPORTS

                  1. are required to provide ESHS monthly monitoring reports to the PMU and Supervising Consultant.   Supervising Consultant are required to provide quarterly ESHS reports to the PMU.  PMU shall submit contractors’ and Supervising Consultant ESHS monitoring reports to the Bank upon request.

 

Upon request from the Bank, and in the case of incidental or unexpected situations.

ESS 1:  ASSESSMENT AND MANAGEMENT OF ENVIRONMENTAL AND SOCIAL RISKS AND    IMPACTS

1.1

ORGANIZATIONAL STRUCTURE:

The Borrower shall establish and maintain an organizational structure within the PMU with qualified staff and resources to support management of E&S risks.

 

The Egypt National Railways Restructuring Project (ENRRP)’s current PMU, including the Director of  ENR’s Environment Advisory Department (EAD) supported by environmental and social specialists from the EAD on an as needed basis, shall be maintained after the ENRRP closure to ensure that components under the Project that will be financed retroactively will be implemented in accordance with the Project E&S instruments and ESF requirements. 

For the RISE project, the PMU shall assign or recruit additional dedicated, qualified, full-time ESHS staffing such that the PMUs organizational structure consists of one Environmental Specialist, one Health and Safety specialist, and one Social Specialist.   ToRs or qualifications for the specialists to be hired or assigned to the PMU to be sent to the Bank for revision and approval.

 

Environmental and social consultants/consulting firms will also be required on an as-needed basis to prepare site -specific environmental and social assessments and management plans under Component 2.

Maintain the current organizational structure within the PMU for ENRRP beyond closing date of ENRRP for at least 30 days after the Project Effective Date.

 

Not later than 30 days after of the Effective Date, assign or recruit additional dedicated, qualified, full-time ESHS staffing such that the PMUs organizational structure consists of one Environment specialist, one health and safety specialist, and one Social Specialist. 

Maintain such organizational structure, including the ESHS specialists, throughout Project implementation.

1.2

ENVIRONMENTAL AND SOCIAL ASSESSMENT:

Adopt, and implement, the Environmental and Social Assessment (ESA) that has been prepared for the Project and cleared by the Bank, in a manner acceptable to the Bank. The ESA includes environmental and social impact assessment of Component 1, an ESMF for Component 2 and an Environmental and Social Management Plan (ESMP).

 

Monitor performance of project activities and associated facilities in accordance with the ESA and related environmental and social management plans. 

 

The ESA was developed and disclosed on December 22, 2020 and shall be maintained and implemented

1.3

MANAGEMENT TOOLS AND INSTRUMENTS

Screen any proposed subproject under Component 2 in accordance with the Environmental and Social Management Framework (ESMF) prepared for the Project, and, thereafter, draft, adopt, and implement the  environmental and social management plans or other instruments required for the respective sub-project in accordance with the ESSs, the ESMF, Labor Management Procedure (LMP), the EHSGs, and other relevant Good International Industry Practice (GIIP) including relevant WHO guidelines on COVID-19, in a manner acceptable to the Bank.

1.4

For Component 3: Ensure that terms of reference for studies, capacity building, training and any outputs of the technical assistance activities  carried out under the Project, including, but not limited to, the carrying out of feasibilities studies for future projects in the transport sector, institutional capacity building needs , are acceptable to the Bank and duly incorporate the requirements of the ESSs.

1.5

MANAGEMENT OF CONTRACTORS

Incorporate the relevant aspects of the ESCP, consistent with the relevant ESSs, including the relevant E&S documents and/or plans, and the Labour Management Procedures, into the ESHS specifications of the procurement documents with contractors through

  1.  Amending the existing works and supervision contracts under Component 1 to reflect the requirements of the relevant E&S documents and/or plans.
  2. Existing Works Contractors and Supervision Consultant under Component 1 shall  supply to the Borrower a chart showing the proposed organization to be established by the Supervision Consultant and Contractors for carrying out work  within twenty-one (21) days of the Works Contracts or Supervision Consultant Contract Effective Date.  The chart shall include the identities of the suitably qualified ESHS personnel and the curricula vitae of such key personnel to be employed shall be supplied together with the chart

  

  1. Works Contractors under Component 1 are required to update/prepare ESHS Management Plans approved by the PMU and Supervision Consultant in accordance with the content specified in the ESA and contract. 
  2. New contracts for works under RISE include the relevant E&S instruments and/or plans, and ESHS specifications consistent with the ESF.
  3. Thereafter ensure that the contractors comply with the ESHS specifications of their respective contracts and other relevant Good International Industry Practice (GIIP). All in a manner consistent with ESS1. Incorporated ESHS specifications to the contracts should be done in accordance with the ESSs.

 

 

 

  1. Prior to the start of activities eligible for retroactive financing.
  2.  Within 21 days of the effective date of the amendment of the existing Works or Supervision Consultant Contracts
  3. Contractors to have ESHS Management Plans updated, prepared, approved, and implemented prior to start of activities eligible for retroactive financing.

ESS 2:  LABOR AND WORKING CONDITIONS 

2.1

LABOR MANAGEMENT PROCEDURES:

Adopt, implement and update the Labor Management Procedures (LMP) that have been developed and adapted for the Project and the code of conduct applicable to all workers in the ESRS.

2.2

GRIEVANCE MECHANISM FOR PROJECT WORKERS:

Update, maintain, and operate an easily accessible grievance mechanism for Project workers, as described in the LMP and consistent with ESS2. 

 

 

Grievance redress for workers is to be operational prior to engaging project workers and maintained throughout project implementation

2.3

OCCUPATIONAL HEALTH AND SAFETY (OHS) MEASURES:

                  1. adopt, and implement occupational, health and safety (OHS) measures as specified in the ESA and the other studies to be prepared under action 1.2 and 1.3 above and specific measures derived from lessons learned from previous incidents under ENRRP, such as safety hazards from patrolling of sites, as well as prevention measures for the spread of COVID-19.

2.4

EMERGENCY PREPAREDNESS AND RESPONSE:

Prepare Emergency Preparedness and Response Plan during the project different phases. Ensure workers and contractors are trained and implement the plan in coordination with measures under 2.3 where relevant.

ESS 3:  RESOURCE EFFICIENCY AND POLLUTION PREVENTION AND MANAGEMENT

3.1

MANAGEMENT OF WASTE AND HAZARDOUS MATERIALS:

As part of the E&S instruments specified in 1.2 and 1.3, develop, adopt, and implement measures and procedures for pollution prevention and the management of waste and hazardous materials related to the rehabilitation and construction work.  All waste streams that will be generated on spot should be identified and monitored. 

Other resource efficiency and pollution prevention and management measures will be covered under the ESIAs/ESMPs to be prepared under actions 1.2 and 1.3 above

After project effectiveness and before issuing bidding documents and commencement of any civil works. Implementation to be continuous during work and Project implementation

ESS 4:  COMMUNITY HEALTH AND SAFETY

4.1

TRAFFIC AND ROAD SAFETY:

Adopt and implement measures and actions to assess and manage  traffic, road and train safety risks arising from project activities including inter alia, safety at level-crossings; preventing traffic congestion and vehicle accidents, and safety for train passengers .

Prior to commencement of any civil works. Implementation to be continuous during civil work under component 2 and Project implementation

4.2

COMMUNITY HEALTH AND SAFETY:

  1. Adopt and implement measures and actions to assess and manage specific health and safety risks and impacts to  communities arising from Project activities including, inter alia,   limited after-hours and weekend traffic and other activities emitting noise and vibrations;  fall and trip hazards, proper implementation and monitoring of bordering and limiting unauthorized access to work sites;  risks arising from labor influx or behaviour of project workers and SEA/SH; and risks of communicable diseases, including spread of COVID-19.  
  2. Develop, adopt and implement measures and actions to assess and manage  risks and impacts on the community in relation to  any new buildings and structures that are accessible to the public in accordance with  the ESAs/ESMPs to be developed under 1.2 and 1.3 above arising from Project activities and the ESSs.  The concept of universal access to such structures and buildings with be applied where technically and financially feasible. 
  3. All direct and contracted workers shall be required to understand and sign a Code of Conduct covering SEA/SH

ESS 5:  LAND ACQUISITION, RESTRICTIONS ON LAND USE AND INVOLUNTARY RESETTLEMENT

RESETTLEMENT FRAMEWORK (RF)

  1. Update, adopt and Implement the Resettlement Framework (RF) that has been prepared for the Project and cleared by the Bank

 

  1. Maintain a database of work locations for the Project sites and screen any potential land impacts in accordance with the RF for activities under Component 2. 

 

  1. Prepare, disclose, and implement RPs under Component 1 for (1) SER 1 – Beba  (2) SER 18 – Deirut  (3)  Manqabad EIS, consistent with ESS5. 

 

 

  1. Thereafter prepare, adopt, and implement Resettlement Plans (RPs) and mitigation measures consistent with ESS5 and the RF before carrying out the subject activities, in a manner acceptable to the Bank. Examples of subject activities may include compensation to tenants and informal farmers cultivating land within the ROW for loss of standing crops, trees or plants or access to them, loss of arable land, loss of assets or structures. 

 

 

  1. The Updated RF was adopted and disclosed in December, 22 2020 and shall be implemented throughout implementation
  2. Screening to be carried out prior to the carrying out of activities under Component 2 and throughout implementation
  3. Not later than one month after the Effective Date and prior to the reimbursement of any costs related to the carrying out of activities under Component 1 for (1) SER 1 – Beba  (2) SER 18 – Deirut  (3)  Manqabad EIS.

ESS 6:  BIODIVERSITY CONSERVATION AND SUSTAINABLE MANAGEMENT OF LIVING NATURAL RESOURCES

6.1

                  1. RISKS AND IMPACTS:
                  1. aspects of this standard shall be considered, as needed, under action 1.2 above and relevant mitigation measures will be taken to avoid any river pollution. Increase monitoring supervision during construction activities that will take place near the water resources to avoid waste mismanagement that might result in river contamination.
